3. REGULATORY STATUS OF THE PRODUCTS
3.1 The products offered on this website are food supplements / complementary health products. In South Africa these products fall within the regulatory framework of the Medicines and Related Substances Act 101 of 1965, administered by the South African Health Products Regulatory Authority (SAHPRA), and, where applicable, the Foodstuffs, Cosmetics and Disinfectants Act 54 of 1972, administered by the National Department of Health.
3.2 The goods are shipped from outside South Africa and are imported by you as importer of record (see Section 6).
3.3 Where a product has not been evaluated or registered by SAHPRA, that fact is disclosed on the relevant product page, together with any statement required by the applicable regulations.
3.4 Claims made about the products are subject to the restrictions on medicinal claims in the Medicines and Related Substances Act 101 of 1965 and the General Regulations made under it, and to sections 29, 40 and 41 of the CPA concerning false, misleading or deceptive representations.
4. HEALTH INFORMATION
4.1 The products sold on this website are food supplements and are not medicines. They are not intended to diagnose, treat, cure or prevent any disease.
4.2 Food supplements are not a substitute for a varied and balanced diet or a healthy lifestyle.
4.3 Do not exceed the recommended daily dose stated on the packaging. Keep out of reach of young children.

5. INTELLECTUAL PROPERTY
5.1 All elements of this website — its structure, text, images, photographs, illustrations, logos, trade marks, video, audio, databases, source code and design — are protected under the Copyright Act 98 of 1978 and the Trade Marks Act 194 of 1993, and remain the exclusive property of MIRELUNA LTD or its licensors.
5.2 No part of this website may be reproduced, adapted, published, distributed, extracted or exploited, in whole or in part, by any means or in any medium, without our prior written consent, save as permitted by law.

6. VAT, IMPORT CHARGES AND LANDED COST
6.1 The goods sold on this website are shipped directly by a third-party supplier located outside South Africa. In terms of the Value-Added Tax Act 89 of 1991, the supply takes place outside South Africa. MIRELUNA LTD is not a registered VAT vendor in South Africa and does not levy South African VAT on these sales. Displayed prices are net of VAT and import duties.
6.2 You act as the importer of record. On arrival of the goods in South Africa you are responsible for paying, directly to the South African Revenue Service ("SARS") or to the delivering carrier:
- import VAT at the rate applicable in South Africa, assessed by SARS on the added tax value of the consignment;
- customs duty at the rate applicable to the tariff classification of the goods;
- customs clearance, brokerage or administrative fees charged by SARS or by the postal or courier service.
6.3 There is no minimum order value below which these charges do not apply. Since 1 September 2024, import VAT applies to all imported consignments, including low-value parcels. Carriers clear every parcel through SARS regardless of declared value, and a clearance fee is payable whether or not duty is assessed.
6.4 These charges are additional to the price you pay us, are not received by us in any part, and are not refundable by us. Where you cancel or return an order, our refund covers what you paid us; import charges paid to SARS or the carrier must be reclaimed from SARS. We will supply the commercial invoice and supporting documentation on request.
6.5 This position is disclosed to you before you complete your order. If anything in this section is unclear, contact us at info@mirevala.com before placing an order.
